2026 Best Use of an Australian Recording in an Advertisement
ARIA AWARD TERMS & CONDITIONS
1. General
1.1. The Terms & Conditions below, together with the 2026 Advertising ARIA Award Entry Criteria comprise the terms upon which Eligible Agencies may pledge their support for the Our Soundtrack Our Ads (OSOA) initiative and submit an entry into the 2026 ARIA Awards in the category Best Use of an Australian Recording in an Advertisement (referred to as the Advertising ARIA Award).
1.2. Australian Recording Industry Association Ltd (ABN 72 002 692 944) (ARIA) will handle all entries and judging for the Advertising ARIA Award, processing of entry payments and all other matters relating to the administration and presentation of the Advertising ARIA Award.
1.3. All matters relating to the conditions of entry, voting and determinations, rulings and eligibility criteria are detailed in the Advertising ARIA Award Entry Criteria which is available here:https://www.aria.com.au/2026-aria-adland-entry-criteria. Any entries which do not meet the criteria or which breach these Terms and Conditions, may be excluded from consideration for the Advertising ARIA Award in accordance with the Advertising ARIA Award Entry Criteria.
1.4. By submitting an entry into the Advertising ARIA Award, the Eligible Agency and entrants agree to be bound by these Terms and Conditions and the 2026 Advertising ARIA Award Entry Criteria.
2. Number of entries that may be submitted for the Advertising ARIA Award
There is no limit to the number of entries that may be submitted, However, an entry fee in the amount specified on the online entry form for the Advertising ARIA Award is payable for each entry that is submitted. This fee is non-refundable unless ARIA cancels the Advertising ARIA Award as applicable (see clause 5.5 of these Terms & Conditions).
3. Closing Dates for Submission of OSOA Pledges and Entries to the Advertising ARIA Award
3.1. In order to be eligible to submit an entry into the Advertising ARIA Award, an Eligible Agency must submit the online OSOA pledge to ARIA.
3.2. If an Eligible Agency wishes to submit an entry for the Advertising ARIA Award, then this must be submitted in accordance with the deadlines published by ARIA on its website. Late entries will not be accepted by ARIA. ARIA accepts no responsibility for late, lost or misdirected entries or any technical issues associated with the submission of an entry in the Advertising ARIA Award.
4. Additional Conditions
4.1. In order to submit an entry into the Advertising ARIA Award, the Eligible Agency must follow the instructions on the online form on the ARIA website and complete all required fields. Incomplete or non-compliant entries may not be accepted by ARIA.
4.2. The person submitting the entry on behalf of the Eligible Agency confirms that:
(a) they are authorised to submit the entry on behalf of the Eligible Agency;
(b) the information contained in in the OSOA pledge and entry for the Advertising ARIA Award is true and accurate;
(c) the entry for the Advertising ARIA Award does not contain any defamatory content and does not infringe the intellectual property rights or privacy of any person; and
(d) if the Eligible Agency is nominated for or wins the Advertising ARIA Award, then a representative from the Eligible Agency agrees to participate in any reasonable promotional activities related to the ARIA Awards, OSOA and/or the Advertising ARIA Award, without compensation.
4.3. If an Eligible Agency submits an OSOA pledge, then it agrees that ARIA may publish the agency’s name (and logo, if supplied by the Eligible Agency) on ARIA’s website, social media and other platforms to indicate that the Eligible Agency has pledged to the OSOA initiative.
4.4. If an Eligible Agency submits an entry for the Advertising ARIA Award, then it agrees that:
(a) ARIA may publish the agency’s name (and logo, if supplied by the Eligible Agency) on ARIA’s website, social media and other platforms to indicate that the Eligible Agency has pledged to the OSOA initiative and submitted an entry for the Advertising ARIA Award; and
(b) ARIA (and its licensees) may use the submitted collateral and assets in connection with the entry on the ARIA website and social/online channels, the ARIA Awards voting platform, the ARIA Awards programs and broadcasts, ARIA associated content and ARIA Awards and OSOA promotions, activities and marketing without payment to the agency, producer, the relevant artist, composer or any other person. By submitting an entry, the Eligible Agency warrants that it has the rights to grant ARIA (and its sublicensees) the right to use the entry for the aforementioned purposes. It is the Eligible Agency’s obligation to obtain permission from the relevant third parties to enable ARIA (and its sublicensees) to use the entry as detailed. The Eligible Agency indemnifies ARIA for any breach of this condition by the Eligible Agency.
4.5. Supporting materials may be requested from an Eligible Agency to enable consideration of an entry for the Advertising ARIA Award. Submission of those materials may be subject to additional terms and conditions as indicated by ARIA.
5. Entry Fee and Payments
5.1. Once the OSOA pledge has been received by ARIA, if accepted, ARIA will then send an invoice to the Eligible Agency for the entry fee for the Advertising ARIA Award, along with login details to enable the Eligible Agency to submit their entry/entries for the Advertising ARIA Award.
5.2. ARIA only accepts payment via Electronic Funds Transfer (EFT) in Australian dollars only. ARIA does not accept cash or credit card payments
5.3. An Eligible Agency will not become a pledgee or be eligible to submit an entry for the Advertising ARIA Award until payment of the entry fee for the Advertising ARIA Award has been received in full by ARIA.
5.4. The entry fee for the Advertising ARIA Award is non-refundable in any circumstances.
5.5. Any fees associated with the submission of an entry for the Advertising ARIA Award will only be refundable if the Advertising ARIA Award is cancelled or does not proceed in 2026. ARIA will not offer any refunds in any other circumstances. If the Advertising ARIA Award is cancelled or does not proceed in 2026, then in such circumstances, the refund of the entry fee will be issued to the Eligible Agency via the same means of payment that was used by the Eligible Agency to make the payment. Proof of payment, such as a receipt or invoice, may be required. ARIA may require additional information, such as banking details, to process the refund. If the necessary information is not provided, ARIA may not be able to process the refund.
6. Privacy
Personal information collected as a result of making the OSOA pledge, submitting an entry to the Advertising ARIA Award or making any payments to ARIA will be handled in accordance with the Privacy Collection Statement and ARIA Privacy Policy. ARIA will collect personal information for the purpose of administering OSOA and for the purpose of administering, producing, promoting and communicating the Advertising ARIA Award, the ARIA Awards and associated content. Personal information supplied as a part of the OSOA pledge and Advertising ARIA Award entry process may also be used for the purpose of judging, voting and announcement the winner of the Advertising ARIA Award and shared with third parties who assist ARIA with these processes and activities. Each Eligible Agency should review these policies for more information about what personal information is collected, how it used, disclosed and stored, and who you can contact for further information or to make a complaint.
7. General
7.1. If you do not agree with these Terms and Conditions, the 2026 Advertising ARIA Award Entry Criteria, or if you cannot comply with it, then you must not submit an entry for the Advertising ARIA Award.
7.2. If, for any reason, ARIA is unable to award or present the Advertising ARIA Award as planned due to causes beyond ARIA’s control, then ARIA reserves the right, at its sole discretion, to cancel, modify or suspend the Advertising ARIA Award. Unless required by law and subject to clause 5.5, ARIA will not be liable for any losses or costs incurred by an Eligible Agency or any other person as a result of the cancellation of the Advertising ARIA Award.
